TRAFFIC
Unless specifically set forth otherwise in a section or subsection, the definitions of terms for purposes of this Chapter shall be the same as those set forth in Chapter 340 of the Wisconsin Statutes. The word "person" as used throughout the ordinance shall be deemed to include any individual, partnership, firm, or corporation.
Pursuant to 349.06 Wisconsin Statutes, all provisions of Chapters 340 to 348 of the Wisconsin Statutes describing and defining regulations with respect to vehicles and traffic for which the penalty is a forfeiture only, including forfeiture to be imposed and procedure for prosecution, are hereby adopted and by reference made part of this ordinance as if fully set forth herein, except as otherwise specifically provided in this Code.
Any act required to be performed or prohibited by a statute incorporated herein by reference is required or prohibited by this ordinance.
Any further amendments, revisions, modifications, or newly‑created provisions of the Wisconsin Statutes, incorporated herein, are intended to be made part of this Chapter in order to secure uniform statewide regulation of traffic on the highways, streets, and alleys of the State and are incorporated herein. Sections of the Wisconsin Statutes adopted herein shall have the same number in this Chapter and may be so cited.
(1) Conduct Prohibited". No person shall, within the County of Wood, by or through the use of any motor vehicle, including but not limited to an automobile, truck, motorcycle, minibike, or snowmobile, cause or provide disorderly conduct with a motor vehicle.
(2) Definition". Disorderly conduct with a motor vehicle shall mean, while operating or in control of a motor vehicle to engage in conduct or activities which are violent, unreasonably loud, dangerous to persons or property, or otherwise against the public peace, welfare, and safety, including but not limited to unnecessary, deliberate, or intentional spinning of the wheels, squealing of the tires, revving or racing of the engine, blowing of the horn, causing the engine to backfire, or causing the vehicle, while commencing to move or while in motion, to raise one or more wheels off the ground. Specifically excluded from this definition are legitimate, scheduled racing events.
All provisions of the following Chapters of the Wisconsin Administrative Code describing and defining regulations with respect to vehicles and traffic are hereby adopted and by reference made part of this ordinance as if fully set forth herein:
Chapter MVD 3 ‑ Reciprocity ‑ non‑resident motor carriers
Chapter MVD 5 ‑ Standards for motor vehicle equipment
Chapter MVD 6 ‑ Transportation of explosives by motor vehicle
Any act required to be performed or prohibited by any administrative code incorporated herein by reference is required or prohibited by this ordinance. Any future amendments, revisions, modifications, or newly‑ created provisions of the incorporated administrative codes are intended to be made part of this Chapter and are incorporated herein. Sections of the Wisconsin Administrative Code adopted herein shall have the same number in this Chapter and may be so cited.
The penalty for violation of any provision of this Chapter shall be a forfeiture as hereinafter provided, together with court costs.
(1) State Traffic Statute Forfeitures". The forfeiture for violation of the Wisconsin Statutes adopted herein shall conform to the forfeiture to be imposed for violation of such statutes as set forth in the Wisconsin Statutes, including any amendments, revisions, modifications, or newly‑created provisions.
(2) Other State Statutes and Administrative Code". The forfeiture for violation of those Chapters of the Wisconsin Administrative Code adopted by 222.4 of this Chapter shall not be less than $20.00 and not more than $200.00.
(3) Miscellaneous Traffic Regulation Forfeitures". The forfeiture for violation of the regulation set forth in 222.3 of this Chapter shall be not less than $20.00 and not more than $200.00.
(4) Forfeiture When Not Expressed". If a person is convicted of an act or omission prohibited by this Chapter for which no penalty is expressed, the person shall be subject to a forfeiture of not less than $20.00 and not more than $200.00.
(5) Other Sanctions".
A. Court.
1. The Court may also exercise authority to suspend the operating privileges of an individual convicted of a violation found in Chapter 340 to 348 of Wisconsin Statutes. The Court may also exercise any other authority granted to it for violations of above sections.
2. The Court may require compulsory safety school attendance for violations of 346.01 to 348.28 of the Wisconsin Statutes.
3. Pursuant to 66.115 Wisconsin Statutes, the Court may order imprisonment for failure to pay the forfeiture for violations of the provisions adopted or suspension of operating privileges under 345.47, Wisconsin Statutes.
4. The Court may impose such other penalties or sanctions as are authorized by Wisconsin Statutes for violations of local traffic ordinances.
It is the authority of the Wood County Sheriff's Department to enforce the provisions of this Chapter. Sworn law enforcement officers at all levels within the County shall have authority to issue citations or complaints for violations of this Chapter. This Chapter shall be enforced in the same manner as prescribed by the provisions of 345.20 through 345.53 of the Wisconsin Statutes.
222.07 REPEAL OF CONFLICTING ORDINANCES"
All ordinances regulating traffic upon the streets, alleys, and highways of the County of Wood, Wisconsin and all ordinances or parts of ordinances heretofore enacted by the County Board of Wood County, Wisconsin in conflict herewith are hereby repealed.
If any section, clause, or division of this ordinance be declared by the court to be invalid, the same shall not affect the validity of the ordinance as a whole or any part thereof, other than the part so declared to be invalid.
